1.2. This Website can be accessed at www.renateweyer.com and is owned and operated by Renate Weyer.
1.3. This Website Terms and Conditions (“Terms and Conditions”) govern the selling and purchasing of goods and the use on this Website. If you are uncertain, or you do not agree with the Terms and Conditions then please do not use the Website or Service.
1.4. These Terms and Conditions are binding and enforceable against every person that accesses or uses this Website.
1.5. Renate Weyer may, in its sole discretion, modify or revise these Terms and Conditions at any time and You agree to be bound by such modifications or revisions.

PART 1: INTERPRETATION AND DEFINITIONS

2. General
2.1. Unless inconsistent with or otherwise indicated by the context:
a) Clause headings in this agreement are for convenience only and shall be ignored in its interpretation.
b) An expression which denotes a natural person shall include a juristic person and vice versa and the singular shall include the plural and vice versa.

3. Definitions
3.1. Where used in this agreement the following expressions shall bear the meanings assigned to them hereunder.
“Agreement” means these Terms and Conditions;
“Buyer” an active, registered user or a “Guest User” of Renate Weyer who locates and purchases Products via the Website;
“Buyer payment options” the payment options Renate Weyer makes available to a buyer now or in the future to pay for purchases on the Website.
“Checkout process” shall mean:
a) A user clicking on add to cart button after browsing the Website.
b) A user being redirected to cart page.
c) Each seller is listed a specific cart for each store
d) User will click on checkout button and proceed with required fields on page
e) once payment is completed user will be directed to Thank You page and checkout process will be complete.

“Fees” means any charges which Renate Weyer charge;
“Guest user” means a user who uses the Website without registering an account;
“Renate Weyer Marketing Materials” means any images, links, documents or other marketing materials pre-approved and provided by Renate Weyer to You via the marketing materials area in the Platform that you are authorised to use;
“Indemnified Party” means Renate Weyer, its officers, employees, contractors, consultants and agents from time to time, and any related entities, associates or affiliates of Renate Weyer, and each of their respective officers, employees, contractors, consultants and agents from time to time;
“Intellectual Property Rights” means industrial and intellectual property whether protected by common law or under statute including (without limitation) copyright and neighbouring rights, all rights in relation to inventions (including registered patents and the benefit of any applications for a patent), plant varieties, plant breeders, registered and unregistered trade marks, registered and unregistered designs including drawings, circuit layouts and all other rights resulting from intellectual activity in the industrial, scientific, literary or artistic fields anywhere in the world;
“Platform” shall mean the feature of Renate Weyer through which you manage your content and account on www.renateweyer.com;
“Privacy Policy” means the policy as at www.renateweyer.com;
“Product” shall mean and include, but not be limited to goods and services such as unique engagement rings, wedding bands and various beautiful jewelry pieces.
“Registration Data” means the information about users as requested by various Renate Weyer registration forms;
“Seller” means Renate Weyer;
“Website” means the Internet website by which Renate Weyer offers the Products from time to time, currently www.renateweyer.com;
“Third-Party payment provider” means any third party that processes payments on behalf of users, namely Payfast at present;
“Transaction” is created when a Buyer completes Renate Weyer’s checkout process;
“User” or “Users” means any Buyer(s), or someone who is otherwise using the Website;
“User Account” the registering of user information through Renate Weyer, in order to purchase products through Renate Weyer;
“VAT” means any value added tax, or other consumption tax;
“We”, “Us”, “Our”, “Ourselves” and “Renate Weyer” are used interchangeably in this Agreement and all mean Renate Weyer or her authorised representative/s;
“You” or “Your” means you, as a Buyer, as the case requires, or otherwise, and your successors and permitted assigns; and
“Your information” includes all information you provide to us in using this Website, including, without limitation, as applicable:

a) your registration details, including name and address details;
b) your credit card details;
c) the information about any goods and services that you post on this Website; and
d) the information that we learn about you as a result of your use of this Website, including without limitation, through the goods and services you post on this Website if you are a Seller, and the goods and services you purchase if you are a Buyer.

PART 2: PURCHASING ON THIS WEBSITE

4. The Buyer
4.1. You agree and warrant to us that your information:
4.1.1. is accurate and not false, misleading, deceptive or fraudulent;
4.1.2. does not breach any Intellectual Property Rights of a third party;
4.1.3. is made in compliance with all applicable laws, government regulations or guidelines;
4.1.4. is not forged, threatening or offensive or otherwise constitutes harassment;
4.1.5. does not contain confidential information or trade secrets of a third party unless you have obtained the consent of the third party owner;
4.1.6. does not contain any viruses, worms, Trojan horses or other invidious programs or data, whether attached to or embedded in other programs or data or not;
4.1.7. the purchase of any goods and/or services on this Website is absolutely at your own risk;
4.2. You agree that you will utilise the Buyer Payment options made available to you by Renate Weyer, namely;
4.2.1. the use of the third- party payment provider; or
4.2.2. credit card payments (this facility may only be available at a future time); and
4.2.3. an Electronic Fund Transfer (EFT) into Renate Weyer’s account.
5. Product Availability
5.1. All orders placed on this Website is subject to availability and acceptance of your order by Renate Weyer.
5.2. Renate Weyer products are handmade, we reserve the right to change the assortment of items offered and to limit the quantity of items that may be purchased, without prior notice.
5.3. Visit our product pages on this Website or contact us via telephone or email to enquire about any products that are currently available for sale.
6. Prices, Tax and Shipping Costs
6.1. All prices shown on the product pages of this website are in South African Rands and are only valid at the time your order is placed.
6.2. Renate Weyer may modify prices and delivery costs at any time without prior notice.
6.3. Actual shipping costs and applicable taxes will be reflected in the Order Confirmation.
6.4. Shipping costs are not stated on the product pages and will only be added to the product price after selecting your preferred delivery option, before your order is finalized.
7. Purchase Confirmation
7.1. When a buyer places an order through the Website or by telephone, you are making an offer to Renate Weyer to purchase the products in accordance with these Terms and Conditions.
7.2. Renate Weyer will not be held liable for any incorrect details completed on any order placed through the Website. The buyer will be held responsible for ensuring that all their details are correctly captured before finalizing their order.
7.3. Once the buyer has confirmed all their details and placed the order, Renate Weyer will send you an acknowledgement email that your order has been received. Upon shipping of the buyer’s order, we will send you another email to confirm your order (“Order Confirmation”).
7.4. The Order Confirmation will be proof of a binding agreement between you and Renate Weyer.
8. Shipping Policy
8.1. Renate Weyer makes customized Wedding Bands and Engagement Rings by hand and require 6 – 8 weeks to complete an order.
8.2. Ready to wear jewellery can be shipped immediately after payment has been verified. Shipping may take 3 – 10 working days depending on the area and type of shipment option chosen.
8.3. Valuable items like Wedding Bands and Engagement Rings are fully insured by Renate Weyer from its time in transit until it is delivered to you.
8.4. Renate Weyer requires the signature by an adult to confirm acceptance of each Renate Weyer design product delivered. Once delivery takes place, Renate Weyer will no longer be held liable for any loss or damage to the product and responsibility will pass to you as the Buyer.
8.5. If you have specified a recipient other than yourself for delivery purposes (for example as a gift), you acknowledge and accept that evidence of a signature by such recipient (or at that delivery address) is proof of delivery and fulfilment of the sale by Renate Weyer and responsibility passes to the recipient in the same way as if the product had been delivered to you.
8.6. Tracking records indicating delivery shall be evidence of delivery and fulfilment of the contract by Renate Weyer.
9. Damaged Goods (Shipping)
9.1. Renate Weyer takes great care to ensure that no product gets damaged during transportation.
9.2. All shipments have tracking numbers, and delivery requires the signature of recipient or an adult legally residing in the household. Upon delivery, Renate Weyer will not be held liable for loss, damage or destruction of the product.
9.3. Should any product be damaged during transportation, please notify Renate Weyer immediately upon receipt, but no later than twenty-four hours after your receipt.
9.4. An investigation will be launched to establish the cause of the damage during transit and the courier service will be held liable if found that they are directly responsible for the damages incurred.
10. Return Policy
10.1. Renate Weyer jewellery is created with the highest ethical standards and craftsmanship. All Wedding Bands and Engagement rings are made on order after entering into a contract for the full purchase price as agreed upon. These items can not be returned or exchanged.
10.2. Ready to wear jewellery can be returned or exchanged if you are not happy with your purchase, you may use the Renate Weyer 14-day return and exchange policy.
10.3. You will be liable for return shipping cost on any product or item returned to us. Shipping costs are non-refundable. If you receive a refund, the cost of the return shipping will be deducted from your refund.
10.4. Each piece must be returned in its original packaging, unworn condition within 14 days of the initial shipment together with all of the original documentation.
10.5. Customized and/or altered items that have been repaired and/or re-sized or have been previously exchanged will not be eligible for return or exchange.
10.6. Any refunds will be issued to the credit card used for the purchase.
11. How To Return An Order
11.1. Please contact us at info@renateweyer.co.za prior to returning any merchandise with your reason why you would like a refund/exchange. Please ensure to carefully package each piece in its original packaging with the proper padding.
11.2. Renate Weyer will not be responsible for any item lost or damaged during transit.
